Tomorrow, Sam Bankman-Fried will take the courthouse stage, facing 21 days in court during his criminal trial scheduled to end on November 9th. Specifically, SBF stands accused of seven counts of conspiracy and fraud relating to the collapse of FTX, including fraud, money laundering and campaign finance offenses in addition to commodities fraud, securities fraud, and conspiracy to defraud the United States and commit campaign finance violations due to an extradition agreement with the Bahamas from where Bankman-Fried had been deported.
Notably, SBF will provide three weeks of never-before-seen entertainment—disorganized chaos of a sort; however, this chaotic saga will too feature several witnesses for the DOJ who are set to testify during the trial that includes former FTX clients, investors and staff members. FTX customers who had deposited funds on FTX will likely testify as to their expectations of the exchange’s deposit and withdrawal policies at any time. Similarly, FTX investors who purchased shares of FTX will likely testify as to their expectations of the company being a custodian of user funds.
Generally speaking, cooperating witnesses who pled guilty to participating alongside SBF in a conspiracy to commit fraud are expected to discuss their interactions and engagements with SBF, in particular. Interestingly, SBF will be unable to apportion blame on FTX lawyers given the risk of confusion and unfair prejudice to the government that exists due to the lacks of specific details regarding “what they were present for or involved in, what their tasks were, what exactly they knew, and what the defendant knew about what the lawyers knew and were doing . . . “ See https://storage.courtlistener.com/recap/gov.uscourts.nysd.590939/gov.uscourts.nysd.590939.303.0.pdf.
Stay tuned for bickering, confusion, and courtroom chaos to the max . . . and, remember, you are ALWAYS welcome to play ‘League of Legends’ while watching the SBF trial. I mean, for a complete understanding of the trial, it may be a fundamental requirement.
